NEW YORK A.B. 8912 – Chemical Bans/Restrictions

Summary: Prohibits, as of January 1 of the year following passage, the sale, distribution and manufacture of toys and childcare products intended for use by children under 14 years of age containing: bisphenol-A or an individual phthalate or combination of phthalates in concentrations that exceed 0.1% if the product may be placed in the child’s mouth.

Prohibits the sale, distribution, and manufacture of toys and children’s products that contain di (2-ethylexyl) phthalate, dibutyl phthalate, or butyl benzyl phthalate in concentrations exceeding 0.1%.

Directs every manufacturer to use the least toxic alternative to these substances.

Provides a fine for every person and corporation which violates any section of this provision of not less than $10,000 each day.
